SCOPE OF PERSONAL DATA AND THEIR SECURITY

We minimize the scope of personal data we process to ensure that it is sufficient to provide the quality services you expect from us, to comply with legal obligations, and to protect our legitimate interests. We process both the personal data of our customers and the personal data of our potential customers who have given us their consent. We process the following categories of personal data:

• Basic data, which is your name and surname, residential address, or business registration number if you are an entrepreneur – a natural person (tradesperson).
• Contact information, which is your email, phone number, or contact address.
• Registration details (name, password) and account settings, if you registered before purchasing.
• Information about products and services you have purchased or are considering purchasing. This includes, for example, data from orders, invoices, payments, or shopping cart data.
• Information about the use of our e-shop, how you behave during your visit, the pages you read, the links you click on, the way you navigate individual pages. This data also includes information about your device (technical parameters, operating system, screen resolution, browser used), information about the IP address of your device and the geographical location derived from it, as well as data obtained through cookies and similar technologies
• Data about reading our newsletter. Whether you received the messages, the time you opened the messages, the content that interested you, the links in the messages that you clicked on, and data obtained through cookies and similar technologies.
• Records of email and chat communications, records of phone calls, or other communications with you in electronic or written form.
• Transaction data, in particular information about your payments and payment methods.
• Technological data and logs that are recorded in information systems during your visits to our website or during communication. This data includes in particular the static (permanent) or dynamic (temporarily assigned) IP address of your device, data about the operating system, the browser used, the time and duration of the visit or communication.

We protect your personal data using effective security technologies and organizational measures. All data is encrypted, protected by a new generation of firewalls and regularly backed up. Only professionally trained employees and professionally vetted suppliers have access to it.

We will provide you with more information on the technical and organizational security measures that we, as a digital service provider, have implemented in accordance with the Cybersecurity Act and which are based on ISO/STN 27001 standards upon request.

PURPOSES AND LEGAL BASIS OF PROCESSING

We process your personal data primarily to enable you to make a comfortable purchase and to deliver the ordered goods to you. We process your personal data in accordance with the law, based on the following legal bases:

Processing based on the consent of the data subject pursuant to Art. 6 para. 1. letter a) GDPR

• For the purpose of sending an information newsletter, to which you can subscribe via the form on our website. You can withdraw your consent to receive the newsletter at any time.
• For the purpose of displaying behavioral advertising based on your interests according to the previous content of the pages you visited. You can withdraw your consent granted through cookies at any time. (More about cookies )
• For the purposes of organizing consumer competitions, which you can voluntarily participate in if you meet the conditions for participation in a particular competition.

Processing based on the performance of a contract pursuant to Art. 6 para. 1. letter b) GDPR

• For the purposes of ordering and delivering goods (preparation and execution of purchase contracts concluded remotely)
• For the purposes of business communication, in the preparation and implementation of business contracts, when ordering goods, delivering them, as well as providing related information.
• For the purposes of registering on the e-shop, as a step that, based on your decision, precedes the conclusion of a contract and allows you to make more convenient repeat purchases, gain an overview of your orders, as well as the ability to access your data and edit it.
• For the purpose of providing data for the delivery of goods by couriers. The companies we use provide services pursuant to Act No. 324/2011 Coll. on Postal Services and subsequently process your data as a third party for the period necessary for the delivery of shipments.

Processing based on a legal obligation pursuant to Art. 6 para. 1. letter c) GDPR

• For the purposes of handling complaints, pursuant to Act No. 250/2007 Coll. on Consumer Protection, Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods at a Distance or Off-Premises
• For the purposes of maintaining accounting and tax records, pursuant to Act No. 431/2002 on accounting, Act No. 222/2004 Coll. on VAT and Act No. 595/2003 on income tax
• For the purposes of network and information system security, pursuant to Act No. 69/2018 Coll. on Cybersecurity and pursuant to Article 32 of the GDPR Regulation
• For the purposes of processing requests from data subjects related to the exercise of rights under the protection of personal data under the GDPR.

Processing based on the legitimate interest pursued by us as a controller pursuant to Art. 6 para. 1. letter f) of the GDPR

• For the purpose of sending an information newsletter to customers, in connection with registration or purchase. You can unsubscribe from the newsletter at any time.
• For the purpose of verifying customer satisfaction in connection with the progress of the last purchase.
• For the purposes of communication via social networks, in connection with your interaction with content published by us via our fan page, website, newsletter, blog, etc.
• For the purposes of maintaining a legal agenda related to the establishment, defense and exercise of legal claims.
• For the purposes of monitoring stores with a camera system , intended to protect the property of the operator and customers and to protect the health and life of persons located in the store premises.

PERSONAL DATA RETENTION PERIOD

If we process your data based on consent, we will process it for the duration of your consent, but for a maximum of 3 years. After this period, we will destroy it. This period may be shorter, for example:

• In the case of sending a newsletter, 24 months from the last opening
• In the case of displaying behavioral advertising, depending on the type of advertising system, 6 months to 3 years

If we process your data based on the performance of a contract , we will process it for the duration of the contract and 5 years after its termination.

If we process your data based on a legal obligation, we will process it for the period specified by the relevant legislative regulation.

• In the case of accounting, this period is 10 years
• In the case of complaints, this period is 2 years from the complaint.
• In the case of cybersecurity, this period is 12 months

If we process your data based on the legitimate interest pursued by us as the controller, we will process it for the period strictly necessary to achieve the purpose of the processing.

• In the case of camera systems, this period is 72 hours.
• In the case of sending a newsletter, 24 months from the last opening
• In the case of proving, defending and exercising legal claims until the period after which they will be time-barred (for civil disputes 3 years)

YOUR RIGHTS RELATED TO THE PROTECTION OF PERSONAL DATA

• You have the right to access your personal data , as well as the right to know for what purpose it is processed, who the recipients of your personal data are, and what the processing period is.
• You have the right to rectification , if your personal data is incorrect or has changed, contact us and we will correct it.
• You have the right to have your personal data erased if it is incorrect or processed unlawfully.
• If your personal data is processed based on consent, you have the right to withdraw your consent at any time , without affecting the lawfulness of processing based on consent given before its withdrawal.
• You have the right to restrict processing , if you wish we will process your data only for the most necessary legal reasons, or not at all.
• You have the right to data portability ; if you wish to transfer your data to another controller, we will provide it to you in an appropriate format, unless other technical or legal obstacles prevent this.

We will respond to your request free of charge within 30 days. In case of complexity or a large number of requests, we are entitled to extend this period by another 60 days. If this happens, we will inform you about it and the reasons.

However, if your request is clearly unfounded or repeated, we are entitled to charge a reasonable administrative fee to cover the costs associated with providing this service.
